Recently hit by another driver, got estimate for his insurance company. Not sure I should repair for that cost

My car is a 1994 Lexus ES300 with 125,000+ miles on it. I would say it is in good or fair condition, the leather seats are cracking badly and it has a few scrathes, etc. I'm just wandering if it is in my best interest to repair this car or for it to be totaled out. The estimate for repairs in $3500.00, which could always go up once repairs start for unseen damage. I'm just not sure the car is worth repairing for that amount considering its condition. The damage is to the drivers side rear panel which is now rubbing something when I turn either way or go over any kind of bump in the road. The estimate does not consider repair for that since that could not be seen by looking at the vehicle. They are also saying the paint can't be matched perfectly because of the fading caused by sun and weather over the years. With everything considered my resale value is not good. I did want to sale this car at some point and get newer car.

I've carried my auto and homeowners insurance with State Farm for about 15 years. I've had multiple auto claims but only one claim on my homeowners poicy. I had my roof replaced about four years ago when most houses in the area were damaged by hail. I've been very happy dealing with state farm but I'm considering a change to travelers. Travelers sent me a quote that if accurate reduces my homeowner insurance to about $900 per year as compared to the slightly lower benefits from State Farm which is costing $1200 every six months. My hubby had two claims from a sleep study clinic that were marked as Out of network by my insurance. As such, the insurance company cut me a check for the portion of the bill that they are required to pay (instead of paying the clinic directly). I had to cash them immediately or else the checks would be void. Normally, we get a bill from the clinic with our total bill (including what the insurance needed to pay) and we then pay what the insurance wrote us a check for in addition to our portion. Basically I have just changed jobs, where I had company cars for the last 6 years with no claims. I asked A&L if they would accept this as no claims, and they said they would if I could provide a letter from my previous employers stating dates, that I was sole user, that I no longer have policy and that it expires within last 3 months etc. I have provided them with the letter which covers all areas requested. They have now replied back to me saying that they can't accept the no claims, as I have 2 SP30 (Motorway speeding) convictions within the last 5 years, which means they will not accept the no claims. Is this acceptable? I though no claims were only relinquished if a claim in made against a policy, not because I have a couple of run-of-the-mill speeding convictions. Thanks in advance, James

Why is car insurance compulsory here in FL?

I own my car. The cheapest car insurance (only) cover $10k on damages which is called PIP insurance and it is required by law. If the PIP insurance only covers $10k on damages, and I have more than 10k dollars on my bank account why in helllllll do I have to give my hard-earned money to these moth*rfu(kers? In 2008 I had insurance in California, through my employer. I got laid off in June, but was on COBRA in Sept. 2008, when Blue Cross authorized me for gastric bypass surgery. In Oct 2009, owing to a dispute over COBRA payments, my insurance lapsed. As of Nov 1 I have no coverage, and new insurance through my wife's Kaiser won't start until Jan 1. Yesterday (Dec 23 09) I had to go to the ER due to abdominal pain that turned out to be a complication of the 2008 gastric bypass. Last night I had a CT scan and emergency surgery to correct the problem. Blue Cross rejected the claim, which of course makes sense and pushing it through was just a formality anyway. But today I wondered if, since the procedure was covered originally, would surgery to correct a complication be covered by law even if my insurance lapsed? I know I'm grasping at straws here, but it seems like it might be worth a consultation with an attorney to find out. I think this surgery is going to run to $40K or more. It was a simple laproscopic procedure, but y'know nothing's cheap. The original bypass was billed to Blue Cross at $38K. I know it's not like defect liability, since a surgeon can't guarantee there will not be complications. Also, I know I can't expect free legal advice here. But if someone knows for sure or has thoughts one way or the other would be helpful.
